Tampa Bay Lightning Phone Text Message Class Action Settlement - Up to $45.00 - June 08, 2020

    The Tampa Bay Lightning NHL team has agreed to pay nearly $2.3 million to resolve allegations that their fans received unsolicited text messages.

    The settlement benefits people who were sent at least one text message in connection with the Tampa Bay Lightning Bolts Insider Text Club after texting a keyword to the short code 61873.

    Plaintiff Bryan Hanley claimed in his class action that he and other consumers received unsolicited text messages from the Lightning Bolts as a part of the team’s Insider Text Club. These texts were allegedly sent to consumers after they texted a keyword to the short code number.

    Although the Lightning fans had sent a keyword to the short code, they claimed they had not consented to receiving further text messages from the sports team. According to Hanley, these texts violated the federal Telephone Consumer Protection Act (TCPA).

    Tampa Bay Sports and Entertainment LLC, the operator of the Tampa Bay Lightning, has not admitted any wrongdoing under the TCPA but has agreed to resolve the claims against them with a settlement worth up to $2.25 million. The settlement will start at $1.4 million and will be increased depending on the number of claims filed.

    Under the settlement, Class Members will reportedly be able to collect a proportional share of the net settlement fund. Each payment is estimated to be around $45.00, but this may change depending on the number of claims filed and the amount collected for fees and costs.

    In order to benefit from the settlement, Class Members need to file a valid claim by June 8, 2020. The deadline for exclusion is March 9, 2020. The deadline for objection is March 23, 2020.
