Wells Fargo Employee Credit Report Class Action Settlement - $46.85 - Deadline: April 14, 2020

Wells Fargo has agreed to pay $3.8 million to resolve claims that they violated the Fair Credit Reporting Act with employee background checks.
The settlement benefits people who had a consumer report procured by Wells Fargo between June 1, 2015 and Jan. 24, 2016.
Plaintiff Jennifer Rivera filed her Wells Fargo class action lawsuit in October 2017. According to Rivera, the bank wrongfully procured consumer background reports for prospective employees without their consent.
Although background checks are completely legal and are a common part of the pre-employment process, businesses must comply with federal laws such as the Fair Credit Reporting Act (FCRA) by informing prospective employees of the reports and gaining written consent.
Rivera claimed that Wells Fargo failed to provide the sufficient disclosures to her and other individuals before procuring a consumer report. The bank allegedly committed further violations when it failed to get consumer written consent.
Wells Fargo has not admitted any wrongdoing but has agreed to pay $3.8 million to resolve the claims against them.
A claim form is not required to recover payment from the Wells Fargo class action settlement. By taking no action, Class Members will automatically receive a cash payment of around $46.85. If a sufficient number of checks remain uncashed by Class Members, a second round of checks worth over $10 may be distributed.
The settlement will also cover up to $1.27 million in attorneys’ fees, expenses of up to $25,000, settlement administration costs of around $120,520, and a service award of up to $5,000 for Rivera.
If Class Members wish to object or exclude themselves from benefits, they must file these requests by April 14, 2020. The final approval hearing for the Wells Fargo class action settlement is scheduled for May 11, 2020.
