A number of safety measures will be implemented at all blood drives including:

• Checking the temperature of staff and donors before entering a drive to make sure they are healthy.

• Providing hand sanitizer for use before the drive, as well as throughout the donation process.

• Wearing gloves and changing gloves with each donor.

• Staff, donors and all visitors wearing face masks at all times.

• Spacing beds to follow social distancing practices between blood donors.

• Wiping down donor-touched areas between each donor.

• Increasing enhanced disinfecting of surfaces and equipment.

• Appointments are strongly recommended to help control the crowd, and maintain social distancing.

The Tampa Bay Lightning NHL team has agreed to pay nearly $2.3 million to resolve allegations that their fans received unsolicited text messages.

The settlement benefits people who were sent at least one text message in connection with the Tampa Bay Lightning Bolts Insider Text Club after texting a keyword to the short code 61873.

Plaintiff Bryan Hanley claimed in his class action that he and other consumers received unsolicited text messages from the Lightning Bolts as a part of the team’s Insider Text Club. These texts were allegedly sent to consumers after they texted a keyword to the short code number.

Although the Lightning fans had sent a keyword to the short code, they claimed they had not consented to receiving further text messages from the sports team. According to Hanley, these texts violated the federal Telephone Consumer Protection Act (TCPA).

Tampa Bay Sports and Entertainment LLC, the operator of the Tampa Bay Lightning, has not admitted any wrongdoing under the TCPA but has agreed to resolve the claims against them with a settlement worth up to $2.25 million. The settlement will start at $1.4 million and will be increased depending on the number of claims filed.

Under the settlement, Class Members will reportedly be able to collect a proportional share of the net settlement fund. Each payment is estimated to be around $45.00, but this may change depending on the number of claims filed and the amount collected for fees and costs.

In order to benefit from the settlement, Class Members need to file a valid claim by June 8, 2020. The deadline for exclusion is March 9, 2020. The deadline for objection is March 23, 2020.

The County of Los Angeles has agreed to pay a total of $53 million to settle class action allegations that women inmates were subject to degrading strip searches while entering or returning to the Century Regional Detention Facility in Lynwood, Calif.
.
The settlement represents the largest payout in the county’s history.
.
The Lynwood strip search settlement website notes that Class Members include those who were subjected to a strip search in a group outside of the bus garage while entering or returning from the Los Angeles Sheriff’s Department Lynwood Jail between March 5, 2008 and Jan. 31, 2015.
.
Lead plaintiffs claimed that thousands of inmates were subjected to unnecessary and violating strip searches. Plaintiff Jessica Almaraz alleged that she was strip searched a total of five times during her time at the Sheriff Department’s Century Regional Detention Facility.
.
According to the female inmates, women were often strip searched in groups. They say that they were forced to take off their clothes and be invasively strip searched in front of other women. Allegedly, deputies degraded them and yelled profanity during these searches.
.
The plaintiffs claim that this treatment violated their Fourth Amendment rights.
.
Eligible Class Members will be able to receive at least $200 for one strip search, while those who experienced numerous strip searches are likely to end up with thousands of dollars.
.
Inmates must complete and return a Claim Form to receive monetary recovery. According to the strip search class action, qualifying individuals should have received a Claim Form in the mail. Class Members may also compete a Claim Form online.
.
Class Members can exclude themselves from the settlement, or object to it by June 4, 2020. Those who excluded themselves from the settlement retain their right to pursue independent litigation over the strip searches, but waive their rights to claim benefits from this settlement.
.
Former inmates who do nothing will receive no benefits, and waive their rights to pursue independent litigation.
.
Class Members can also attend the final approval hearing on July 20, 2020, in which a judge will decide whether or not the settlement will be approved.

A $135 million settlement has been reached to resolve claims that Navistar knowingly sold defective truck engines which were prone to breaking down.

The settlement benefits truck drivers who purchased or leased a 2011 to 2014 model year vehicle equipped with a MaxxForce 11- or 13-liter engine certified to meet EPA 2010 emissions standards without selective catalytic reduction technology.

The Navistar class action claimed that the company knowingly sold MaxxForce 11- or 13 liter diesel engines with defective EGR emissions systems. The defect allegedly causes the engines to heat up more than comparable engines which reportedly leads to more frequent break downs.

The plaintiffs argued that, if they had known about the defect, they would not have purchased the affected vehicles or would have paid significantly less. As a result, the plaintiffs and Class Members allegedly sustained financial injury.

A $135 million settlement was reached over the summer to resolve the claims against Navistar, although the defendants did not admit any wrongdoing.
.
Under the settlement, consumers have three options for compensation. They can collect up to $2,500 in cash, up to $10,000 in rebates towards the purchase of a new vehicle, or up to $15,000 in proven cost reimbursement. More information is available in the “Potential Award” section below.

In order to benefit from the settlement, Class Members need to file a valid claim by May 11, 2020. The deadline for exclusion and objection was Oct. 10, 2019. The settlement was granted final approval on Jan. 3, 2020.

Who’s Eligible

Associated Management Services, Inc., and Charles D. Fuszner, D.M.D., P.C. Jaguar Land Rover has agreed to pay $6.7 million to resolve claims that it sold Range Rovers with defective suspensions.

.
The settlement will benefit current and former owners and lessees of Land Rover Range Rover vehicles from model years 2003 to 2006.
.
The Land Rover class action lawsuit was first filed more than six years ago. Since then, it has been fiercely litigated by both sides of the complaint.
.
The plaintiff claimed that certain Land Rover Range Rovers were equipped with a defective suspension system. The systems allegedly included front air springs which cracked or leaked, leading to a loss of air pressure.
.
As a result of the defect, vehicles were reportedly unable to travel in a straight line leaving drivers at risk of losing control of their Range Rover.
.
Jaguar Land Rover has not admitted any wrongdoing but has agreed to pay $6.7 million to resolve the claims against them. A settlement was originally reached in 2017, but was denied due to concerns over Class Member definitions and compensation rates.
.
The amended settlement reportedly addresses these concerns, which the plaintiffs argue make it a “very good settlement.”
.
Under the settlement, consumers can collect up to $500 in reimbursements for out-of-pocket repair costs. The amount each Class Member can collect is limited by the age and mileage of their vehicle at the time of repairs. More information is available in the “Potential Award” section below, but the payouts range from $125 to $500.

In order to receive payment, eligible consumers need to file a valid claim and provide various documentation including proof of payment and proof of ownership.

Consumers have secured more than $6.8 million in cash and other relief in an Atkins net carbs class action settlement, putting allegations to rest that the diet food manufacturer mislabeled the products’ sugar alcohol and/or polyol contents.

Class Members include those who purchased Atkins products made with sugar alcohol or polyol. Sugar alcohol is known as maltitol and polyol is also known as glycerin.

Purchases in New York, Missouri and California must have been made between Jan. 1, 2013 and the present. Purchases in other states must have been made between Jan. 1, 2014 and the present to qualify for the settlement.

Atkins was hit with multiple class action lawsuits over the contents of the products based on the popular “low-carb” diet, initially created by Dr. Robert Atkins. The plaintiffs alleged that various foods made by Atkins Nutritionals Inc. were mislabeled in regards to their net carb contents.

Under the auspices of the Atkins diet, dieters attempt to lose weight by restricting their sugar and carb intake to as low as possible. Atkins Nutritionals allegedly addressed dieters’ cravings for candy and chocolate by offering substitutes containing “no net carbs.”

However, according to a Atkins net carbs class action lawsuit, the company ignored one type of carbohydrate called sugar alcohols. Atkins denied that sugar alcohols affected the net carb content of their products, but the plaintiffs say scientific research shows these ingredients still affect blood sugar levels.

Despite not admitting any wrongdoing, the company agreed to offer both cash and other relief to Class Members as a part of the Atkins net carbs class action settlement.

Under the terms of the settlement, Class Members can receive reimbursement for the purchase of any of the following Atkins products; Chocolate Covered Candies, Chocolate Peanut Candies, Milk Chocolate Caramel Squares, Peanut Butter Cups, and Chocolate Caramel Mousse Bars.

Class Members who provide a receipt or other proof of purchase can receive 25 percent of the purchase price of the product. There is no limit to the number of products that can be claimed with proof of purchase.

Class Members without proof of purchase can receive 10 percent of the purchase price of the product. Class Members can receive up to $100 in reimbursements without proof of purchase.

In addition, Atkins has agreed to modify its labels to remove statements regarding the impact of sugar alcohols and polyols on blood sugar, remove several products containing sugar alcohols, and reduce or remove maltitol from its products.

To make a claim in the Atkins net carbs class action settlement, Class Members must complete and submit a claim form online or via mail. Claim forms must be submitted by April 27, 2020.

Wells Fargo has agreed to pay $3.8 million to resolve claims that they violated the Fair Credit Reporting Act with employee background checks.

The settlement benefits people who had a consumer report procured by Wells Fargo between June 1, 2015 and Jan. 24, 2016.

Plaintiff Jennifer Rivera filed her Wells Fargo class action lawsuit in October 2017. According to Rivera, the bank wrongfully procured consumer background reports for prospective employees without their consent.

Although background checks are completely legal and are a common part of the pre-employment process, businesses must comply with federal laws such as the Fair Credit Reporting Act (FCRA) by informing prospective employees of the reports and gaining written consent.

Rivera claimed that Wells Fargo failed to provide the sufficient disclosures to her and other individuals before procuring a consumer report. The bank allegedly committed further violations when it failed to get consumer written consent.

Wells Fargo has not admitted any wrongdoing but has agreed to pay $3.8 million to resolve the claims against them.

A claim form is not required to recover payment from the Wells Fargo class action settlement. By taking no action, Class Members will automatically receive a cash payment of around $46.85. If a sufficient number of checks remain uncashed by Class Members, a second round of checks worth over $10 may be distributed.

The settlement will also cover up to $1.27 million in attorneys’ fees, expenses of up to $25,000, settlement administration costs of around $120,520, and a service award of up to $5,000 for Rivera.

If Class Members wish to object or exclude themselves from benefits, they must file these requests by April 14, 2020. The final approval hearing for the Wells Fargo class action settlement is scheduled for May 11, 2020.

Verde Energy has agreed to pay up to $5 million to resolve claims stating they violated TCPA by placing unsolicited robocalls.

The settlement will benefit individuals who received a robocall from Verde Energy which used a pre-recorded or artificial voice between Oct. 16, 2013 and Feb. 14, 2019.

Plaintiffs filed their class action against Verde Energy in November 2015. According to the plaintiffs, the energy company placed unsolicited calls to consumers using an automatic dialing system, pre-recorded voice, and/or artificial voice.

“In Defendant’s overzealous attempt to market its services, it placed (and continues to place) phone calls to consumers who never provided consent to call and to consumers having no relationship with the defendant,” the plaintiffs’ Verde Energy class action lawsuit alleged.

“Defendant knowingly made (and continues to make) these telemarketing calls without the prior express written consent of the call recipients.”

The class action claimed that Verde Energy’s phone calls violated the Telephone Consumer Protection Act (TCPA). This federal law protects consumers from harassing telemarketing behaviors including unsolicited calls which use an automatic dialer or pre-recorded/artificial voice.

Verde Energy has not admitted any wrongdoing under TCPA but agreed to settle the claims against them by funding a settlement worth up to $5 million.

TCPA meaning: Telephone Consumer Protection Act of 1991
The Telephone Consumer Protection Act of 1991 was passed by the United States Congress in 1991 and signed into law by President George H. W. Bush as Public Law 102-243. It amended the Communications Act of 1934. The TCPA is codified as 47 U.S.C. § 227. The TCPA restricts telephone solicitations and the use of automated telephone equipment. The TCPA limits the use of automatic dialing systems, artificial or prerecorded voice messages, SMS text messages, and fax machines. It also specifies several technical requirements for fax machines, autodialers, and voice messaging systems—principally with provisions requiring identification and contact information of the entity using the device to be contained in the message.

Under the settlement, Class Members can collect a cash payment. The exact payment amounts will depend on the number of claims filed.

**Johnson & Johnson has agreed to pay up to $6.3 million to resolve claims that its Infants’ Tylenol was deceptively packaged as being uniquely formulated for babies.

The settlement will benefit consumers who purchased Johnson & Johnson Infants’ Tylenol between Oct. 3, 2014 and Jan. 6, 2020.

The Infants’ Tylenol class action lawsuit claimed that the pain reliever was marketed to new parents by including text references to “infants” along with a picture of a mother holding her child. These representations allegedly caused consumers to believe that the medicine was specially created for infants.

However, the plaintiffs say these representations were false. In fact, Infants’ Tylenol allegedly contained liquid acetaminophen that was the same concentration found in Children’s Tylenol. The misrepresentations reportedly caused consumers to overpay for the medication based on their belief that the pain reliever was special or unique.

Johnson & Johnson, the manufacturer of Tylenol, has denied any wrongdoing. According to the company, Infants’ Tylenol is associated with safety features for infants such as a syringe for safe dosing practices. However, the company has agreed to pay into a $6.315 million settlement to resolve the claims against them.

The Infants’ Tylenol class action settlement will provide $2.15 to consumer for every 1 or 2 fl. oz. bottles purchased. If a Class Member can provide proof of purchase (receipts, etc.), they can collect an unlimited number of bottles. If a Class Member does not provide proof of purchase, they can collect up to seven bottles for a maximum payment of $15.05.

In order to benefit from the Infants’ Tylenol class action settlement, Class Members need to file a valid Claim Form by April 13, 2020. The deadline for exclusion and objection is also April 13, 2020. The final approval hearing for the settlement is scheduled for May 11, 2020.

Macy’s has reached a $257,500 settlement deal with customers, ending claims that the company did not do enough to protect against a data breach.

The settlement offers remedy for consumer injury allegedly caused by the data breach that occurred between May 1, 2018 and June 11, 2018.

Class Members eligible for the Macy’s data breach class action settlement include customers who live in the United States and received a notification in July 2018 from Macy’s, regarding unauthorized activity that resulted from the cyber attack.

Plaintiff Anna Carroll filed the Macy’s data breach class action in 2018. She claimed that she made multiple purchases with her online Macys.com account and the company notified her on June 7, 2019 that her information had been compromised in a data breach.

According to Carroll, she was informed that a third party had likely gained access to the personal information linked to her account, including name, birthday, credit card number, and contact information.

She says that she and many other customers were financially injured because they are now vulnerable to identity theft.

Macy’s denies the customers’ claims, but agreed to settle the Macy’s class action to avoid the continued costs and risks of litigation.

The Macy’s data breach class action settlement deal notes that two types of payments are available to Class Members who submit claims for benefits by April 6, 2020, including:

Reimbursement for documented expense related to the cyber attack, up to $1,500
Reimbursement for undocumented time spent attempting to recover from the cyber attack, up to 2 hours at $15/hr, for a total of $30
Class Members who accept these class action settlement benefits waive their rights to pursue legal action against Macy’s over this issue.

Those who wish to be excluded from the settlement Class will not receive payment but they retain their rights to pursue independent legal action against Macy’s regarding the data breach. Exclusion requests must be submitted by Jan. 7, 2020.

Class Members may object to the Macy’s data breach class action settlement, and can write to the Court explaining why they object to the settlement deal. The deadline for objection is also Jan. 7, 2020 for electronic submissions or Jan. 3, 2020 for mailed objections.

Those consumers who do nothing will receive no payment, and will waive their rights to pursue legal action against Macy’s over the cyber attack.

Class Members are also welcome to attend the hearing on April 30, 2020, where they can share opinions with the Court about the settlement deal.

Under the terms of the settlement agreement, claims are capped at $192,500, and the the total amount of the settlement fund will not exceed $257,500, including attorneys’ fees, administrative fees, and named plaintiff awards.

A $195,000 Quest class action settlement will resolve claims that a 2016 data breach compromised the information of thousands of patients.

The settlement benefits individuals whose information was obtained by an unauthorized third party in the 2016 Quest data breach.

The Quest data breach reportedly took place in November 2016 when unauthorized users gained access to Quest Diagnostics’ MyQuest application.

As a result of the data breach, the information of around 34,000 patients was allegedly compromised. Exposed data reportedly included names, dates of birth, telephone numbers, and even lab results including HIV results.

Plaintiffs in the Quest data breach class action claimed that the company failed to protect consumer information from being compromised. Additionally, the patients claimed that Quest did not provide “timely, accurate and adequate notice” of the data breach.

“Despite the fact that it was storing sensitive Private Information that it knew or should have known was valuable to and vulnerable to cyber attackers, Quest and its fellow Defendants failed to take adequate measures that could have protected user’s information,” the Quest class action lawsuit alleged.

Quest Diagnostics has not admitted any wrongdoing but has agreed to fund $195,000 in settlement payments to affected consumers.

The settlement provides up to $325 in compensation for individuals affected by the Quest data breach. Up to $250 can be collected per patient in compensation for actual monetary losses that resulted from the breach. An additional payment of $75 can be collected by patients who had their HIV test results compromised, regardless if actual monetary losses occurred.

In order to benefit from the settlement, Class Members must file a valid claim form by May 22, 2020. The deadline for exclusion and objection was Jan. 8, 2020. Final approval was granted to the settlement at the fairness hearing on Feb. 25, 2020.

Volkswagen has agreed to pay $57 million to settle a VW suspension class action lawsuit claiming that the company sold defective vehicles.

The VW suspension defect class action settlement benefits current or former owners and lessees of model year 2009 through 2017 Volkswagen CC vehicles.

The VW suspension class action lawsuit was filed by 16 customers who claimed that their Volkswagen CC vehicles possessed a suspension alignment problem that caused premature wear and tear on the tires.

According to the drivers, Volkswagen was aware of the problem but did not attempt to fix it, and represented the vehicle as free from defects.

Allegedly, Volkswagen charged drivers out-of-pocket to fix the problem. The Volkswagen suspension class action lawsuit went on to claim that the problem could not be solved by replacing the tires, as Volkswagen recommended to consumers.

Many of the drivers’ allegations were dismissed in September 2018, after a judge deemed several of the drivers’ arguments around limitation periods insufficient.

In agreeing to end the suspension problems class action lawsuit in a $57 million settlement, Volkswagen has not admitted wrongdoing. Rather, the company has agreed to settle to avoid the costs of continuing to litigate.

Class Members who submit valid claims with required supporting documentation may be eligible for reimbursement for some out-of-pocket tire expenses. These expenses must have occurred within 35,000 miles of use of the replaced tire.

**Class Members are limited to a maximum of $209 for each qualifying 235/45R17 replacement tire and $245 for each qualifying 235/40R18 replacement tire.

Additional reimbursement of up to $56 per rotation is also available for expenses incurred within 9,000 miles of tire replacement. Two free tire rotations from an authorized Volkswagen dealer may also be available for current owners and lessees.**

The deadline to submit a claim is April 25, 2020. Customers must support their claim for compensation with supporting documentation, such as repair records, receipts, proof of payment, and proof of compliance with maintenance requirements.

**The deadline for exclusion and objection is Dec. 30, 2019. The final approval hearing is scheduled for Jan. 27, 2020.

TikTok, Inc., the company behind TikTok, has agreed to pay $1.1 million to resolve claims that the app collected children’s personal information without parental consent.

If approved, the settlement would benefit all people who registered for or used TikTok, or its predecessor Musical.ly, while under the age of 13. The settlement would also benefit these individuals’ parents.

Plaintiffs Sherri LeShore and Laura Lopez filed their TikTok class action on behalf of their minor children in December 2019, alleging that the video app unlawfully gathers data from users under the age of 13.

Information gathered by the app reportedly included email addresses, phone numbers, full names, and any information the user included in their TikTok profile.

The plaintiffs argued that this data collection violated various federal and state laws including the Children’s Online Privacy Protection Act (COPPA).

The $1.1 million TikTok class action settlement was submitted by the plaintiffs to the court and received preliminary approval in December 2019.

The defendants in the case have denied and do not admit to any wrongdoing by settling the claims against them.

“Plaintiffs believe that this settlement—which partly arises out of COPPA violations and involves the unlawful collection of children’s personally identifiable information and/or viewing data without parental consent—represents the first settlement of its kind,” the plaintiffs noted in their TikTok class action settlement motion.

Under the settlement, Class Members will be able to receive payments estimated to be between $10 and $15. Exact payments amount will depend on the number of claims filed.

In order to benefit from the settlement, Class Members need to file a valid Claim Form by April 16, 2020. The deadline for exclusion and objection is March 17, 2020. The final approval hearing for the settlement is scheduled for May 6, 2020.

Playboy has agreed to pay $3.85 million to resolve claims that the entertainment company shared Michigan magazine subscribers’ information without consent.

The settlement benefits individuals with a Michigan street address who subscribed to a Playboy publication between Jan. 1, 2016 and July 30, 2016, excluding individuals who opted out of Playboy’s information sharing service.

Plaintiff Mark Kokoszki filed his Playboy magazine privacy class action lawsuit in February 2019. According to the plaintiff, Playboy Enterprises Inc. illegally shared magazine subscriber information with third parties without obtaining consumer consent.

Allegedly a third party can spend under $0.11 to receive a variety of information about Playboy subscribers. This information reportedly includes state, ZIP code, age, income, gender, and email address.

As a result of these purchases, third parties have sent a variety of junk mailings to Kokoszki. He says he received an influx of unwanted mail from “aggressive advertisers, political organizations, and nonprofits” as a direct result of Playboy sharing his information with third parties.

“These harassing junk mailings received by Plaintiff Kokoszki are attributable to Playboy’s unauthorized rental, exchange, and/or disclosure of his Personal Reading Information,” the Playboy class action lawsuit claimed.
.
Playboy allegedly violated Michigan consumers’ rights by repeatedly sharing their information. Kokoszki claimed that, by repeatedly sharing the information instead of outright selling the data away, the company secured significant profits as it repeatedly took advantage of its subscribers.
.
“By renting, exchanging, or otherwise disclosing – rather than selling – its customers’ Personal Reading Information, Playboy is able to disclose the information time and time again to countless third parties,” the Playboy class action lawsuit alleged.

The plaintiff claims that Playboy violates Michigan’s Preservation of Personal Privacy Act (PPPA) by sharing consumer information without consent.

This law protects Michigan consumers from unwanted breaches of privacy, including the unauthorized sharing of personal reading information. Under the PPPA, consumers can collect around $5,000 in statutory damages per violation.

Playboy did not admit any wrongdoing under Michigan’s PPPA, but agreed to resolve the claims against them in a $3.8 million class action settlement in February 2020. As a result of the settlement, Kokoszki and participating Class Members will release their claims against the company.

Under the settlement, Class Members can collect an equal share of the net settlement fund. Class counsel estimates that Class Member payments will be around $220. However, exact payment amounts will vary depending on the number of eligible Class Members and the amount deducted in fees and costs.

According to the settlement, the deal is a favorable outcome for the plaintiffs and “represents the best result ever achieved on a per-class member basis in an action brought under the Michigan Preservation of Personal Privacy Act (the ‘PPPA’).”

In an effort to resolve TCPA claims against them, Checkers Drive In has agreed to a class action settlement to pay consumers who received unwanted text messages from the food company.

Class Members include anyone, nationwide, who got an advertising text message from or on behalf of Checkers or Rally’s between Dec. 21, 2013, to March 8, 2019.

The Checkers unwanted text class action lawsuit alleged that the fast food restaurant lured customers by offering free food if they texted a certain number. The lead plaintiff alleged that, after she texted that number to get a free cheeseburger, she was bombarded by 10 advertising messages from Checkers. The plaintiff said that only a single message offered her the opportunity to opt-out of the advertising messages.

According to the complaint, these Checkers and Rally’s text messages violated the Telephone Consumer Protection Act, or TCPA. Enacted in 1991, the TCPA limits the ability of advertisers to contact potential customers by phone and fax. The Act was updated to include prohibitions against advertising text messages. Failure to comply with the TCPA can lead to big fines for advertisers and the companies who hire them. Each violation can result in a $500 to $1,500 fine.

The Checkers unwanted text class action lawsuit alleged that consumers received these messages without providing prior permission, as required under the TCPA. The plaintiff accused Checkers of wasting her and other Class Members’ time, cell phone data, and battery.

Checkers has denied any wrongdoing, but agreed to pay Class Members two $5 vouchers, good for purchases at any Checkers or Rally’s restaurants. The vouchers will be valid for one year. Further, Checkers has agreed to stop using its database of cell phone numbers to send further advertising text messages.

To make a claim in the Checkers unwanted text class action settlement, Class Members must submit a claim form either online or by mail. The claim form must include the Class Members’ cell number that they used between Dec. 21, 2013 and March 8, 2019.

A settlement worth $12 million has been reached to settle claims that ASUS laptops are equipped with defective batteries.

The settlement benefits consumers who purchased an ASUS Rog Strix GL502VS or GL502VSK laptop between May 4, 2014 and Nov. 19, 2019.

Plaintiff Joseph Carlotti filed his ASUS class action lawsuit in May 2018, alleging that laptops manufactured by the company were equipped with a faulty battery that caused power problems and overheating issues.

Carlotti reportedly experienced the defect after purchasing his laptop for a two month trip abroad. During that time, he allegedly felt heat emanating from the laptop and experienced poor graphics. Even after repairs and replacement, Carlotti says he continued to experience the defect which rendered the laptops inoperable.

The ASUS class action lawsuit claimed that the defective battery results in several consequences such as battery draining even when the laptop is plugged in, performance issues while on low battery, and degradation of the battery.

In mid-2019, ASUS agreed to a $11.9 million settlement to resolve the claims against them. The company did not admit any wrongdoing by settling the ASUS class action lawsuit.

Under the settlement, Class Members can receive either a cash payment of up to $110 or an ASUS credit certificate worth up to $210.

The settlement also establishes an extended warranty for ASUS Rog Strix GL502VS laptops. More details regarding the extended warranty are available in the “Potential Award” section below.

The manufacturers of Grove Square Coffee have agreed to pay $25 million to settle class action claims that its single cup products meant to be used in Keurig machines contain instant coffee instead of ground coffee.

Alabama, California, Illinois, New Jersey, New York, North Carolina, South Carolina, and Tennessee consumers who purchased Grove Square Coffee in the single cup version between Sept. 30, 2010 and Sept. 30, 2014, could get cash from this settlement.

The Grove Square Coffee class action alleges that Grove Square Coffee Light Roast, Grove Square Coffee Medium Roast, and Grove Square Coffee Dark Roast single cup products are made up of more than 96 percent instant coffee.

This lawsuit is about the packaging of Grove Square Coffee. Plaintiff’s allege that Grove Square Coffee, through its packaging of Grove Square Coffee, misled consumers into believing that Grove Square Coffee Light Roast, Grove Square Coffee Medium Roast, and Grove Square Coffee Dark Roast products for use in Keurig ® brewing machines contained premium, ground coffee when the products actually consisted of more than 96% instant coffee. Plaintiffs argue the Defendants violated various state consumer protection and unjust enrichment laws. The Defendants deny any wrongdoing and deny all of the allegations made in the lawsuit.

Under the terms of the Grove Square class action settlement, Class Members will receive between $25 and $275. Alabama consumers may file a claim for a maximum $100 payout; New York residents who file a valid claim can expect to receive $275; consumers in California, Illinois, New Jersey, North Carolina, South Carolina and Tennessee can claim $25 per product up to three items for a maximum total of $75.

It is too late to opt out of the Grove Square Coffee class action settlement, but Class Members who wish to object to its terms must do so in writing no later than March 23, 2020.

The deadline to file a claim is May 7, 2020 and the final hearing will take place on April 21, 2020.

Who’s Eligible
Class Members include consumers who bought Grove Square Coffee in Alabama, California, Illinois, New Jersey, New York, North Carolina, South Carolina, and Tennessee between Sept. 30, 2010 and Sept. 30, 2014.

Did you have Chinese laminate flooring installed between 2012 and 2016? You may be eligible to claim a 50% or 100% refund from a class action settlement.

The $2 million settlement resolves allegations that Eternity Floors d/b/a L.A. Hardwood Floors sold Chinese-manufactured laminate flooring between Jan. 1, 2012 and Dec. 31, 2016 that contained higher formaldehyde emissions than what is allowed under California law. Eternity Floors denies these allegations.

Since the laminate flooring was mainly sold to contractors who installed the flooring for residential customers, many individuals may not realize they have the affected flooring installed in their home. If you had new laminate flooring installed at any time between Jan. 1, 2012 and Dec. 31, 2016, you are encouraged to look through your invoice to see if the flooring was manufactured by Eternity Floors d/b/a L.A. Hardwood Floors. If you do not have an invoice, you can ask your contractor or installer to verify where the purchase was made.

L.A. Hardwood Floors has agreed to pay $1 million in cash and another $1 million in store vouchers to end class action allegations that the formaldehyde emissions coming from Chinese-manufactured laminate flooring was in violation of the Airborne Toxic Control Measure found in Chapter 17 of the California Code of Regulations.

In addition, the L.A. Hardwood Floors class action settlement resolves allegations that its Chinese-manufactured laminate flooring was misrepresented as being durable and having a better abrasion rating than customers actually experienced.

Eternity Floors expressly denies the allegations and admits to no fault or liability but agreed to settle due to the expense and inconvenience of further litigation.

Under the terms of the settlement, Class Members have been divided into two Classes – Verified Purchasers and Other Purchasers.

Verified Purchasers are Class Members who are able to provide proof of purchase with their claim form including invoices, sales receipts, or other written documents that confirms the sale of the flooring. Verified Purchasers can claim cash or store vouchers equal to 100 percent of the original purchase price.

Other Purchasers are Class Members who are unable to provide proof of purchase but submit photographs of their flooring and provide the name of the retail store and date of purchase. Other Purchasers can request cash or store vouchers totaling 50 percent of the purchase price.

The final payout amount will be adjusted on a pro rata basis as it will depend on if Class Members opt for the cash award or store voucher benefit.

If the settlement fund is not completely exhausted, Class Members may be awarded additional benefits.

Class Members must file a claim form no later than April 14, 2020 to get cash or store credit from this class action settlement.

Those who want to object or opt out of the settlement must do so by April 14, 2020. The final hearing is scheduled for May 18, 2020.

Who’s Eligible
All U.S. residents who purchased Chinese-manufactured laminate flooring from Eternity Flooring d/b/a L.A. Hardwood Floors between Jan. 1, 2012 and Dec. 31, 2016.

As noted above, many individuals may not realize they have the affected flooring installed because they did not purchase it directly through Eternity Flooring d/b/a L.A. Hardwood Floors. If you had a contractor or other company install laminate floors between 2012 and 2016, you are encouraged to check your invoice or contact the installer directly to inquire about where they purchased the flooring. A verified purchase could mean that you receive a 100% refund!

Potential Award
50% to 100% refund.

Class Members who can provide proof of purchase along with their claim form are eligible for cash or store vouchers equal to 100 percent of the original purchase price. These Class Members are considered Verified Purchasers.

Those who are unable to provide proof of purchase are eligible for cash or store vouchers totaling 50 percent of the purchase price. These Class Members are considered Other Purchasers.

The amount each Class Member receives is also subject to a pro rata distribution, meaning that it is unknown at this time what the final payout will be as it depends on if Class Members choose the store voucher or cash award.

In the event that the settlement fund is not fully depleted, Class Members may receive additional benefits.

Verified Purchasers (those who provided proof of purchase) who opted for the cash award may receive up to 200 percent of the purchase price.

Other Purchasers (those who did not submit proof of purchase) who selected the cash award are eligible for up to 100 percent of the purchase price.

In the event that the total payout of store vouchers is less than $300,000, then Verified Purchasers who opted for the store credit may receive up to 250 percent of the purchase price. Other purchasers who selected the store voucher option can get up to 100 percent of the purchase price.

Not required. However, Class Members who submit proof of purchase such as a sales receipt, invoice or other documents showing a purchase from Eternity Flooring or one of its distributors are eligible for cash or store vouchers equal to the original purchase price.

Those Class Members who are unable to provide proof of purchase but submit a photograph of their purchased product, the name of the retail store and date of when they purchased the flooring are eligible for cash or store vouchers totaling 50 percent of the original purchase price.
